Advertising and Privacy Compliance in India: Insights and Recommendations for 2023

Since the implementation of the General Data Protection Regulation (GDPR) in the European Union in 2018, the world has witnessed a global revolution in privacy take place. In 2020, a mere 10% of the world’s population lived in countries with privacy regulations. A mere three years later, 130 countries representing almost two-thirds of the world’s population have enacted privacy regulations. India is no exception to these trends. In 2017, the Supreme Court recognised privacy as a fundamental right of Indian citizens. While the Personal Data Protection Bill (PDP) of 2019 did not get through Parliament, its successor, the Digital Personal Data Protection Bill (DPDP), proposed by the Ministry of Electronics and Information Technology (MeitY), will be tabled in July 2023.
