According to Fox, Article III standing exists for violations of Illinois’s Biometric Information Protection Act (BIPA) when companies collect or retain biometric information in alleged violation of the act, without any other injury.
Overview:
Recently, the U.S. 7th Circuit Court of Appeals held that Fox v. Dakkota Integrated Systems LLC alleged a technical violation of the Illinois Biometric Information Privacy Act (BIPA) was sufficient to establish the Article III standing required in order to proceed in federal court, reversing the District Court’s dismissal of the claims.
